Alberta judge proposes new guidelines for Indigenous offenders who say they are Indigenous during sentencing hearings.
Jonathan Anthony Ninan was sentenced to 33 months in prison for robbing a Leduc sports bar.
He requested a Gladue report, a pre-sentence document which examines the impacts of government policy towards Indigenous people on an Indigenous person’s criminal conduct.
Indigenous offenders should present “some objective or independent form of proof” to show they are accepted by an Indigenous community, Stuffco said.
He urged sentencing judges to take into account policies intended to erase Indigenous identity.
Stuffco acknowledged Ninan has lived a hard life which reduces his moral blameworthiness for the robbery.
