U.S. District Judge Tanya Chutkan rejected a request for a temporary restraining order sought by 14 Democrat -led states.

The states have argued that Elon Musk and the White House's , known as DOGE , have unchecked authority.

The White House said Musk is categorized as a special government employee.

A New Mexico lawyer calls the actions by DOGE a " one -of-a-kind situation" Chutkan: Musk is a private citizen tasked with directing an organization with access to "the entire workings of the federal government" She says the mass firings of thousands of federal workers is "not a small or common thing" and noted Musk has not been nominated to a position by the president nor confirmed by the Senate .

But Justice Department lawyers say they are not aware of any source of legal authority.
