D.C. Circuit Court of Appeals votes not to disturb a temporary restraining order preventing Trump from moving forward with removal of Office of Special Counsel chief Hampton Dellinger .

The case is an early test of the sweep of Trump ’s power and could wind up at the Supreme Court within days or hours .

The D.C. Circuit did not release its decision until shortly before 11 p.m. Saturday .

The appeals court’s ruling does not preclude the Trump administration or Dellinger from coming back to the court after Jackson rules on a preliminary injunction.

The Justice Department had asked the appeals court to rule by Friday at noon , but the decision was delayed.
