Transportation Secretary Sean Duffy circulated a memo shortly after he was confirmed as transportation secretary.

The memo calls for giving preference to communities with marriage and birth rates higher than the national average when awarding grants.

Such changes could be a boon for projects in Republican -majority states, which on average have higher fertility rates.

Legal experts say it is too early to know whether anything in Duffy ’s memo could be struck down by the courts.

It is difficult to make a legal argument for funding equality based on political affiliation.

But federal law does protect against discrimination over such things as race, sex, and disabilities.
