Former Calgary city councillor Joe Magliocca may not be testifying in fraud and breach of trust trial.
Defence counsel Aryan Sadat indicated he wouldn’t be calling his client as a witness in his own defence.
Sadat said he would have to consult with his client overnight to determine if he wishes to further challenge the admissibility of a statement the accused made to an independent auditor.
The defence lawyer indicated Monday the statement was voluntary and therefore could be used by Crown prosecutor Aaron Rankin .
