The Centers for Medicare & Medicaid Services suspended two large private sector enrollment websites in August .
Agency cited âserious lapse in the security postureâ that could have led to marketplace data, including consumersâ personal information, being accessed from overseas.
Regulators will audit the two companies because they have âreasonable suspicionâ that they are players in a separate problem: signing people up for Obamacare coverage without their permission.
The filing calls the Sept. 2 CMS letter explaining the reasons for the suspensions âa post hoc justificationâ that includes a litany of âconcerns, suspicions, allegationsââ The filing also asserts âthese intimations of violations are made without evidence of any actual violationâ The suspensions will prevent the companies from participating in the upcoming open enrollment period, court documents say.
