Special counsel Jack Smith says a judge's dismissal of the case against former President Donald Trump must be reversed.
Prosecutors say a judge made a grievous mistake by ruling that Smith was unlawfully appointed by Attorney General Merrick Garland .
The case includes dozens of felony charges alleging Trump illegally retained classified documents from his presidency at his Mar-a-Lago estate.
A three -judge panel of the same appeals court overturned Cannon ’s ruling in December 2022 , ruling that she had overstepped her bounds during the documents investigation.
Prosecutors say the ruling suggests that every special counsel brought in from outside the Justice Department was invalidly appointed.
